These Terms of Service ("Terms") govern your access to and use of the Mayday website (maydaysolution.dev), mobile applications, and services (collectively, the "Services") provided by Mayday Solutions ("Mayday", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Mayday provides an emergency lifeline platform that allows users to connect instantly with help, share videos and critical information, and manage emergency contacts. The Services are provided on a non-exclusive, non-transferable basis, subject to these Terms. Usage may be subject to limitations based on features such as storage or bandwidth.
To use the Services, you must register an account with accurate and complete information, including your name, email address, phone number, date of birth, and emergency contact details. You must be at least 18 years old to register. We reserve the right to reject or terminate accounts that contain inaccurate or misleading information.
Your use of the Services is governed by our Privacy Policy, which explains how we collect, use, and protect your data, including during emergency situations. By using the Services, you consent to the data practices described in our Privacy Policy.
We own all intellectual property rights in the Services, including but not limited to software, designs, text, and branding. You retain ownership of the data you provide (such as videos and emergency contacts), but grant us a license to use that data to provide and improve the Services. Any feedback or suggestions you provide to us may be used by us without restriction or compensation.
You agree to use the Services lawfully and only for their intended emergency-related purposes. The following actions are strictly prohibited:
You are responsible for all activity that occurs under your account and must notify us immediately of any unauthorized use.
We may update these Terms at any time by posting the revised version on our website with an updated effective date. Your continued use of the Services after any changes constitutes your acceptance of the new Terms. We may also modify, suspend, or discontinue any aspect of the Services at any time without prior notice or liability.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@maydaysolution.dev if you become aware of any unauthorized use of your account. We use security measures to protect your data, but you share responsibility for maintaining the security of your account.
We reserve the right to terminate or suspend your account at any time for violations of these Terms, without prior notice and without liability. Upon termination, your access to the Services and your data may be lost. We may retain certain data as required by law. You remain liable for any obligations incurred before termination.
The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee uninterrupted access, error-free operation, accuracy of emergency response outcomes, or timeliness of any information provided through the Services. You use the Services at your own risk, particularly in critical emergency situations where other means of help should also be pursued.
To the maximum extent permitted by law, Mayday Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of life, personal injury, or emergency response failures. Our total liability is limited to the amount paid for the Services in the twelve months preceding the claim. Emergency features depend on third-party services including telecommunications networks and emergency responders, for whose actions we disclaim all liability.
You agree to indemnify, defend, and hold harmless Mayday Solutions and its officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your misuse of the Services, your violation of these Terms, or your infringement of any third-party rights.
These Terms are governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Quebec.
